Aggressive Questioning in Day 4 Wesley Earnest Re-Trial


Amherst Co., VA - An aggressive line of questioning highlighted day four of the Wesley Earnest murder trial in Amherst County.

The defense team made several accusations against the woman who claims she was the 'new love' of Jocelyn Earnest.

The defense is really cranking up their approach in this case. This amped-up strategy is something we really didn't see in the first trial. On Friday morning, when questioning Marcy Shepherd, defense attorney Joe Sanzone said, "You know who killed Jocelyn Earnest because you were there when it happened."

Shepherd denied the allegation. She was also accused of withholding evidence when she told investigators she didn't want to hand over her cellphone, so they could get text messages from it.

The defense says she needed time to delete incriminating messages. Shepherd says she wanted to keep her phone because she was afraid Wesley Earnest would be coming for her.

Shepherd told the judge that Jocelyn Earnest told her that Wesley would kill them both if he ever learned about their relationship. The judge did not allow that testimony into record.

The trial resumes Monday morning at 9:30.


Amherst Co., VA - It was an emotional morning of testimony in the murder re-trial of Wesley Earnest.

Marcy Shepherd took the stand. She was Jocelyn Earnest's co-worker, and also admitted that the two were in a relationship.

Shepherd found Jocelyn's body and was very upset during this morning's testimony as prosecutors showed the jury pictures of the murder scene.

Jocelyn's family members also broke down in the courtroom.
