Man Takes Officer to Court

An area man took a police officer to court Monday and won. Tracy Evans says Brookneal Officer Anthony Earhart threatened him over the phone last month and a judge agreed. Evans said he was looking for justice and says he got it Monday afternoon. This all stems from construction work Tracy Evans did on Officer Earhart's home.
Evans says the contractor didn't pay for the work, so called Earhart to say he would have to file a mechanic's lien on the home. Evans told the court Officer Earhart lost his temper, started cursing him like a dog and threatened him.
Tracy Evans, Filed Complaint - "He said, bring your 'effen a' through Brookneal and see what happens to your 'effen a and that's what made me feel threatened."
No comment from Earhart or his attorney. In court, he admitted to using foul language but said he never threatened Evans. In fact, he says Evans threatened and harassed him.
The judge gave Officer Earhart a $25 dollar fine and he remains on paid leave from the Brookneal Police Department. No word yet on whether he will keep his job there pending an appeal and review by town leaders.
