Governor Kaine's decision to commute Percy Walton's death sentence to life in prison is getting strong reaction. Walton killed an elderly couple and another man in Danville in 1996. He was set to be given a lethal injection Tuesday night.
Governor Kaine says he made the decision because of concerns over Walton's mental state. His supporters agree. But others say the courts and juries have spoken and the death sentence would've been appropriate.
Leigh Drewry, Attorney - "Kaine's job as the Governor is to follow the law and that's what’s been done in this situation. And personal views are irrelevant. It's what does the law say."
Dean Mathew Staver, Liberty University (web) School of Law - "I think it sets a very bad precedent for other individuals in the future who can go out and commit crimes and avoid the death penalty by then creating this insanity."
Experts disagree on Walton's sanity. Kaine says commuting the sentence is the "only constitutionally appropriate course of action."
