Former Deputy Charged with Killing Ex-Wife Waives Preliminary Hearing

Roanoke, VA - The former Franklin County sheriff's deputy accused of killing his ex-wife in a Memorial Day shooting spree has waived his right to a preliminary hearing.

Jonathan Agee, 32, is charged in Roanoke with the first degree murder of Jennifer Agee. Police say she died in a hail of bullets from an AK-47 as she sat in her car, with her daughter, at a Sheetz store in Roanoke.

Agee waiving his right to a preliminary hearing Tuesday basically that means Agee gave up his right to ask for a dismissal and to force the Commonwealth to lay out as much evidence as needed for a judge to send the case to a grand jury.

Since Agee waived his right, no additional evidence was entered and the case will be automatically sent to a grand jury.

The Roanoke grand jury is set for the first week of August.

But before that, Agee's case could go before a Montgomery County grand jury next week where charges are pending for allegedly shooting Virginia State Police Sergeant Matt Brannock in the leg.
