Roanoke, VA - Botetourt County High School teacher Victor Terry, convicted of assault on a student last week, will likely have his charge dropped.
That is the ruling released Tuesday by Roanoke Commonwealth's Attorney Don Caldwell. Caldwell was assigned to look at the case after Terry appealed his conviction.
Caldwell decided that there was not enough evidence to prove assault and has requested the Circuit Court of Botetourt County to dismiss the case.
Terry has been on paid administrative leave since the November incident.
