Montgomery Co., VA - The trial in Montgomery County for Former Franklin County Deputy Jonathan Agee has been moved to August after a motions hearing Tuesday.

Agee faces attempted capital murder charges in Montgomery County for the attempted murder of a State Police officer.

That was part of a series of events including the shooting death of his ex-wife Jennifer last Memorial Day.

Agee was supposed to go to trial for this attempted capital murder and four other felonies next week, but Tuesday's motion was a joint request for a continuance. That motion was granted and the new date is set for August 27. The judge also granted a separate defense motion for the court to appoint an additional attorney for Agee.

Agee is accused of shooting and wounding Sgt. Matthew Brannock along I-81, in Ironto following a high speed chase.

Authorities were after the former deputy after, according to police, Agee opened fire on his ex-wife, Jennifer as she sat in her car at the Sheetz station across from the Roanoke Civic Center. She died instantly.

While the Commonwealth says it is just a coincidence, this change will align Agee's two trials into chronological order as he is scheduled to be tried for Jennifer's murder beginning June 18.

That trial is scheduled to last 10 days in Roanoke's Circuit Court.
