Woman Pleads No Contest in Fatal Hit & Run Case

Lynchburg, VA - A Lynchburg College student faces up to 10 years in prison for running over a Lynchburg man on 12th street.

Kristina Ayala pleaded no contest to felony hit-and-run Monday morning.

Her boyfriend, Kevin Berkley Jr., also pleaded no contest for failing to report the accident. He received 90 days in jail with all the time suspended.

James Haythe was reportedly lying in the middle of the road in the early morning hours of December 23 when he was hit and killed.

The medical examiner ruled he died from crush injuries to the head despite a blood alcohol level of 0.39 around the time of his death.

Police arrested Ayala a week later.

Haythe's family calls Monday's guilty verdict bittersweet.

"Justice will be served regardless, whether it's gonna be in the court or in God's eyes. So, this is something they've gotta live with for the rest of their lives," said Ashley Haythe, the victim's granddaughter.

Ayala is scheduled for sentencing on September 7.
