Martinsville, VA -- New information on last week's double homicide in Martinsville may give some insight to the hours surrounding the deaths.
Darryl Fain, 52, and Kathy Fain, 49, were found in their house last Wednesday shot to death, according to the Henry County Sheriff.
Kathy's son Zachary Bailey, 19 is now facing murder charges.
Bailey was arrested the Sunday before the murder discovery for public swearing and intoxication. But according to the Henry County Sheriff's Office, the double homicide actually occurred sometime between Sunday and Monday. This means Bailey was arrested for intoxication within hours either before or after his mother and stepfather were killed.
Sheriff Lane Perry says Bailey was picked up around midnight Sunday in Collinsville and was kept in custody until the next morning. At the time, they say they kept him for his own safety, which is common for those charges. They didn't find out about the murders until Wednesday.
"It is a point to look at but I can't say it gives us anything more concrete than what we have. It's just behavior to look at, things that were going on in his life there and also seeing where we can find witness statements from," said Perry.
Perry says there is no way to know if Bailey was intoxicated at the time of the homicides.
Also, since Bailey had not been arrested regularly, there was no way to know if he was acting normally that Sunday night.
