Victim's Families Respond to Phillips' Sentence


Lynchburg, VA - A Lynchburg Circuit Court judge sentenced the drunk driver who killed two men on Timberlake Road back in April.

Amy Phillips will spend four years and one month in prison after pleading guilty to two counts of vehicular manslaughter and DUI.

Witnesses say she was driving 80 to 90 miles per hour on April 21, 2011.  Minutes later, she collided with John Hawkins and Eddie Moore as they made a left into the Legacy and Linden Park Apartments.

Although Phillips faced a maximum of 21 years in prison, the Lynchburg Commonwealth's Attorney says her guilty plea makes the process swifter.

"The upside with a guilty plea is there's no appeal. This is final," Mike Doucette said after the sentencing.

According to evidence presented at court, both drivers were over the legal limit at the time of the crash. Phillips reportedly had a 0.14% BAC and Hawkins had 0.16% BAC.

Phillips' defense attorney calls it a terrible accident, terrible tragedy all the way around.

"Amy was the one that chose to drive eastbound on 460. Amy's the one that suffers the consequences of going to jail and living with the thought that she has killed somebody for the rest of her life," Leigh Drewry said.

John Hawkins and Eddie Moore were both 26 years old, born just eight days apart.

"What you do in life can affect so many people," John Hawkins' mother said after the sentencing.

The judge heard about a wanted ad, handwritten by Amy Phillips when she was 11 years old.  Her defense attorney said her mother left when she was 7.

"It says 11-year-old in search of mom, part time mom," Drewry said, explaining she wanted to put the ad in the local newspaper.

"She didn't have the best family. That was not her choice," Danny Hawkins, John's father said about Phillips.

He says he tries not to think about the person who took his son's life, but has "some hope and the hope is for her child."
