Appeals Court Denies Wesley Earnest Appeal

Richmond, VA - An appeals court has denied convicted murderer Wesley Earnest's request for a new hearing, but his attorney says he will appeal to the Virginia Supreme Court.

The Court of Appeals of Virginia released its opinion on the case Tuesday. They determined that the original judge did not abuse his power by refusing to let a witness testify.

The defense wanted to call a doctor to testify that partial fingerprints are not enough to make a definitive match. The judge did not let her testify, saying she was not qualified as an expert. The appeals court agreed with that ruling.

Earnest was convicted of murdering his estranged wife Jocelyn, and is serving a life sentence.
