Lynchburg Murder Trial Delayed for Mental Health Evaluation

Lynchburg, VA - A Lynchburg judge has ordered a mental health evaluation before a murder trial moves forward.

At a motions hearing Tuesday Morning, Gregory Smith, an attorney representing Jose Maldonado, claimed he has a history of mental illness and was under the influence of drugs when police say he stabbed a man to death on Grace Street back in September.

Doctors will determine whether he's competent to stand trial and whether he was sane at the time of the murder. Defense attorneys will use their report to decide whether to pursue an insanity defense.

Maldonado was supposed to go on trial for first degree murder on February 25, but that's been delayed until at least April.
