Judge Certifies Felonies Against Three Suspects in Nativity Theft

Bedford, VA - Charges against three men accused of stealing and destroying a nativity scene from a Forest church are moving forward.

John Killgo, Scott Cooley and Matthew Barringer waived their rights to a preliminary hearing Wednesday afternoon.

The judge certified two felonies -- grand larceny and property damage -- against all three men.

A grand jury will now decide whether to indict them.

John Killgo had no comment after the very brief court hearing.

But you may remember his on camera confession back in December. He said he and his friends stole the nativity scene from the front lawn of Shiloh United Methodist Church as a prank.

Investigators say they then destroyed the plastic figurines, worth an estimated $2,000.

"I want to apologize to the church. I wouldn't want someone to come steal from me," Killgo told ABC 13 News in an exclusive interview before his arrest.

Also at Wednesday's hearing, prosecutors dropped misdemeanor trespassing charges against all three men.

The sheriff's office also charged two juveniles, but there's no word right now on where their cases stand.
