Search Warrant Uncovers New Details in Moneta Shooting


Franklin Co., VA - A woman told police she wasn't expecting her boyfriend home and thought he was an intruder when she shot and killed him inside the home they share in Franklin County.

A Franklin County dispatcher took a 911 call from a cell phone around 1:30 Friday afternoon.

The woman on the other end said she had shot her boyfriend, Herbert Aragon, Jr.

The phone's GPS showed the call was coming from a home on Peaks View Drive in the Waterfront golf community.

A deputy arrived about ten minutes after the 911 call, and said the woman let him in the house. The deputy stated he saw Aragon lying dead in the hallway.

"At that time she advised that she had given her child a bath, when she came out of the bathroom she noticed that the front door was standing open, and she remembered locking the door earlier. She went to the bedroom and retrieved a handgun and began to search the house just to make sure no one was in the house," Lt. Phillip Young with the Franklin County Sheriff's Office.

The search warrant states the woman told deputies Aragon had called her about 15 minutes before the shooting to say he was going to be late. She said Aragon had been on a business trip.

The woman said she saw her son go into his bedroom and look up and she called the toddler back out of the room.

The woman told deputies as she approached the little boy's bedroom, someone jumped out and yelled ‘boo' and she fired.

The woman said she did not know the person was her boyfriend when she shot him.

Investigators seized Aragon and the woman's cell phones along with computer equipment, anything that might have been used to make travel arrangements to prove Aragon was on a business trip or would back up the woman's claim Aragon had called her minutes before.

The search warrant shows the case is being investigated as possible involuntary manslaughter.

Any decision to charge would be made by the Commonwealth's Attorney.
