Henry County Man Pleads Guilty to Killing Mom and Stepfather


Henry Co., VA - A Henry County man has pleaded guilty to killing his own mother and stepfather in their home.

Zachary Bailey, 20, was charged in the murder that happened in the summer of 2012. Charles Darryl Fain and Kathy Fain were found shot to death in their home on Beaver Road in Collinsville back in July 2012.

In court on Monday, Bailey pleaded guilty to two counts of first degree murder and two counts of using a firearm in the commission of a felony.

Prosecutors said that in the weeks before the shooting, Bailey was getting frustrated with his stepfather. They said Bailey was only a few exams away from getting his high school diploma, but had no plans to graduate.

According to prosecutors, he said Charles Fain told him he would not amount to anything if he did not finish high school. They said that's why Bailey shot his stepfather when he got out of the shower, then shot his mom right after.

"I hope they can get some closure from this, that they can start to rebuild and put the pieces back together," said Dawn Futrell, Henry County's Assistant Commonwealth's Attorney.

Prosecutors said Bailey has had a history of mental health issues. They said he has been evaluated twice to determine his competency to stand trial and his sanity at the time of the offense. They also said his mental status issues will most likely come into play in the sentencing. The sentencing is set for April 30.
