Roanoke Man Sentenced For Assault And Battery On Law Enforcement Officer

Christiansburg, VA - On Monday, 34 year old James Taylor Mitchell was sentenced on various counts stemming from an assault on an officer last February.

Mitchell had previously pled no contest to multiple charges in November of 2013.  A judge sentenced Mitchell to a total ten years on five felony charges and twelve months on a DUI 2nd offense. 

Mitchell will have to serve three years and four months in prison before being released on five years of supervised probation.

On February 13, 2013, Trooper Adams of the Virginia State Police pulled behind a stopped vehicle on the right shoulder of I-81 North in Montgomery County.  Mitchell was found slumped over in the driver's seat. 

When asked how much he had to drink, Mitchell stated "not enough."  He was then arrested for Driving Under the Influence and taken to the Montgomery County Magistrates Office, where it was determined he had a blood alcohol content of .15, nearly double the legal limit. 

While in the magistrate's office, Mitchell charged at Trooper Adams, grabbing his shirt and shoving him against the wall.  With the assistance of two other Troopers, Mitchell was taken to the ground and restrained until he calmed down. 

After being placed in a chair, Mitchell got up and charged Trooper Adams a second time, again pinning him to the wall.  Additionally, Mitchell put his hands on Trooper Adams firearm and attempted to disarm him. 

During this struggle, Mitchell kicked Trooper Dunford in the groin.  Mitchell was again restrained until he calmed down.  He was again seated, after which he jumped up and charged Trooper Adams a third time, pinning him to the wall again. 

Mitchell was restrained and turned over to staff at the Montgomery County Jail.   Neither of the Troopers required medical attention.
