Bedford, VA - The case against a Bedford County father charged in connection to the death of his child will go before the grand jury.

Michael Smith has waived his right to a preliminary hearing, according to the Commonwealth’s Attorney.

Smith is charged with two counts of child neglect and one count of conspiring to manufacture meth.

Shana Witt, Smith’s wife, is charged with first-degree murder. Witt’s preliminary hearing is set for July 24, when the results of mental evaluations will be ready.

A search warrant says Witt confessed to smothering their son Jordan Smith, 2, with a stuffed dog in February. A stuffed animal matching that description was found in the boy's bed inside the family's trailer, according to the warrant.
